1. Who We Are and What These Terms Cover
These Terms are an agreement between you and Roman Paprotskyi, trading as Feelings Wheel (“Feelings Wheel,” “we,” “us,” or “our”). These Terms of Use (“Terms”) apply to the Feelings Wheel website at feelingswheel.app, our mobile applications for iOS and Android, and the accounts, content, subscriptions, artificial-intelligence features, and related services we provide through them (collectively, the "Services").
These Terms form a legally binding agreement between you and us. By accessing or using the Services, creating an account, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Services. If you use the Services on behalf of an organization, you confirm that you are authorized to accept these Terms for that organization.
Our Privacy Policy explains how we handle personal data. Nothing in these Terms limits any consumer right that cannot lawfully be limited or waived.
2. Eligibility and Accounts
You must be at least 13 years old and legally able to enter into these Terms to use the Services. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf when local law requires it. The Services are not directed to children under 13.
Some features require an account. You agree to provide accurate information, keep your login credentials secure, and promptly tell us if you believe your account has been accessed without permission. Your account is personal to you and may not be sold, transferred, or shared in a way that compromises its security. You are responsible for activity carried out through your account unless caused by our breach of these Terms or applicable law.
3. The Services
The Services help people identify emotions and support personal reflection. Depending on the platform and plan, features may include an interactive feelings wheel, educational emotion content, guided reflection questions, private notes, emotional check-ins, timelines and calendars, pattern and trend insights, reminders, data export, and optional AI-generated insights and summaries.
Some features are available only in the mobile app, require an account or internet connection, or are limited by platform, device, language, region, or subscription plan. You are responsible for compatible equipment, internet access, and any charges from your network provider.
4. Personal Reflection—Not Professional Care
The Services are designed for emotional vocabulary, self-reflection, and general educational purposes. They are not a medical device, healthcare or mental-health service, crisis service, or substitute for a qualified professional. Nothing in the Services is medical, psychological, legal, or other professional advice, diagnosis, assessment, or treatment.
Do not rely on the Services to make urgent, medical, safety-critical, or treatment decisions. We do not monitor your selections, reflections, notes, or AI interactions for signs of crisis and cannot contact emergency services for you. If you believe you or someone else may be in immediate danger, contact local emergency services or an appropriate crisis service now.
Educators, therapists, coaches, employers, and other professionals may use the Services as a supporting reflection tool, but remain solely responsible for their professional judgment, duties, permissions, and the context in which the Services are used.
5. AI-Generated Features
Some optional features use artificial intelligence to generate insight from selected emotions or, when you request a summary, from relevant reflection records. AI output is generated automatically. It may be inaccurate, incomplete, repetitive, unsuitable for your circumstances, or similar to output provided to other users.
AI output is a prompt for reflection, not a statement of fact or professional judgment. You are responsible for deciding whether and how to use it. Do not treat AI output as a diagnosis, prediction, instruction, or recommendation on which your health, safety, legal rights, finances, or another person’s wellbeing depends.
AI features may have usage limits based on your plan and may be delayed, unavailable, or changed as providers, models, safety measures, and product requirements evolve. We do not promise continued access to a particular AI model or a particular form of output. The Privacy Policy explains how data is processed when you use these features.
6. Your Reflections and Other Content
"User Content" means information you submit or save through the Services, including selected emotions, notes, reflection responses, and other text. You retain your rights in your User Content. These Terms do not transfer ownership of it to us.
You give us a limited, non-exclusive permission to host, store, reproduce, process, and transmit User Content only as reasonably necessary to operate, secure, support, and provide the features you request, and as otherwise described in the Privacy Policy. This permission ends when the content is deleted from our active systems, subject to legally required retention, security records, and routine backup cycles described in the Privacy Policy.
You are responsible for your User Content and must have the right to submit it. Avoid including another person’s confidential or personal information unless you have a lawful and appropriate reason to do so. If you export or share User Content outside the Services, you are responsible for protecting the exported copy.
7. Acceptable Use
You may not use the Services to:
- break the law or violate another person’s rights;
- access or attempt to access another user’s account, reflections, or data without authorization;
- upload malware, probe for vulnerabilities, bypass access or usage limits, or interfere with the security or operation of the Services;
- scrape, harvest, copy, or extract the Services or their content through automated means except where we have authorized it or applicable law permits it;
- reverse engineer, decompile, or attempt to discover source code except to the extent this restriction is prohibited by law;
- impersonate another person, misrepresent your relationship with us, or use the Services to facilitate fraud, harassment, exploitation, or harm; or
- resell, sublicense, or commercially exploit the Services or use them to build a substantially similar competing product without our written permission.
You must also comply with reasonable technical limits and safety measures communicated within the Services.
8. Intellectual Property and Your License
The Services—including their software, visual design, branding, interfaces, databases, and original content—are owned by us or our licensors and are protected by intellectual-property laws. The Feelings Wheel on which the project is based was created by Geoffrey Roberts and is used and developed with his permission. All rights not expressly granted in these Terms are reserved by their respective owners.
Subject to these Terms, we give you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may also display and use the Services in ordinary educational, therapeutic, workplace, or group conversations, provided you do not sell or redistribute the Services, remove attribution, imply our endorsement, or present them as professional diagnosis or care. Downloadable materials may include separate permissions or restrictions.
If you voluntarily send us product feedback, you allow us to use it without payment or obligation to you. This does not apply to your private reflections or other User Content.
9. Pro Subscriptions and Purchases
The mobile app may offer a free Basic plan and paid monthly or yearly Pro subscriptions. The price, currency, billing period, included features, taxes, and any trial or promotional terms shown in the Apple App Store or Google Play purchase screen at checkout form part of your purchase and control if they differ from a general description in the Services.
Pro subscriptions are auto-renewing unless the purchase screen states otherwise. Your marketplace account will be charged at confirmation and at the start of each renewal period until you cancel. You can manage or cancel through the subscription settings of the marketplace account used to make the purchase. Cancellation normally takes effect at the end of the current paid period.
Uninstalling the app or deleting your Feelings Wheel account does not cancel a subscription billed by Apple or Google. Cancel the subscription through the relevant marketplace to prevent future renewal charges. Refunds and billing disputes are generally handled under the marketplace’s rules, subject always to rights provided by applicable law.
We may change Pro features, usage allowances, or future subscription prices for legitimate reasons such as product development, provider costs, security, or legal requirements. Changes affecting an active subscription will be communicated and take effect only as permitted by the marketplace rules and applicable law. Where required, the marketplace will request your consent to a price change before renewal.
10. App Marketplaces and Third-Party Services
If you download the app through Apple or Google, you must comply with the applicable marketplace terms. Marketplace rules concerning installation, device use, family sharing, billing, cancellation, and refunds may apply in addition to these Terms.
For the iOS app, Apple’s Standard Licensed Application End User License Agreement applies to your license to use the app. If that agreement conflicts with these Terms regarding the app license, Apple’s standard agreement controls. These Terms are between you and us, not Apple. We, not Apple, are responsible for the Services and their support, subject to applicable law. Apple and its subsidiaries are third-party beneficiaries of the provisions applicable to the iOS app and may enforce them where applicable.
Some features depend on third-party services for authentication, hosting, analytics, notifications, purchases, or AI processing. Their own terms may apply to your direct relationship with them. We are responsible for our Services, but not for independent third-party websites, services, or outages outside our reasonable control. You must comply with applicable export, sanctions, and trade-control laws when using the Services.
11. Account Deletion, Suspension, and Termination
You may stop using the Services at any time. Account holders can request deletion through the app’s account settings or by contacting us. Deleting your account removes it from active use and makes it inaccessible. It does not necessarily erase every record immediately. Certain account, reflection, subscription, security, and legal-compliance records may remain in restricted storage as described in the Privacy Policy. Export any information you want to keep before deleting your account.
If you want to request permanent erasure of personal data that remains after account deletion, email support@feelingswheel.app. We may ask for information reasonably necessary to verify your identity. We will process your request within the timeframe required by applicable law, subject to limited information we must retain for legal, security, fraud-prevention, or dispute-resolution purposes.
We may restrict or suspend access when we reasonably believe this is needed to protect users or the Services, investigate fraud or a security incident, comply with law, address non-payment, or respond to a material or repeated breach of these Terms. Where reasonable and legally permitted, we will give notice and an opportunity to contact us about the decision.
When access ends, your license to use the Services ends. Provisions that by their nature should continue—including those concerning intellectual property, disclaimers, liability, disputes, and accrued payment obligations—will survive. Account deletion does not cancel a marketplace subscription.
12. Service Availability and Changes
We may update, improve, add, remove, or discontinue features and may release mandatory updates needed for security, compatibility, or legal compliance. We will use reasonable care to avoid materially reducing paid functionality during an active subscription without notice or an appropriate remedy where required by law.
We do not guarantee that every feature will always be available, uninterrupted, error-free, or compatible with every device or operating-system version. Maintenance, provider failures, network conditions, emergencies, or events outside our reasonable control may interrupt the Services.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Services will produce a particular emotional, personal, educational, or professional outcome.
We do not warrant that content, emotion descriptions, analytics, or AI output will be complete, accurate, or suitable for you. You remain responsible for maintaining copies of exported information that you need and for using reasonable safeguards on your device and account.
These disclaimers do not exclude warranties, remedies, or consumer rights that applicable law does not allow us to exclude.
14. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profit, business, opportunity, goodwill, or data, arising from or relating to the Services, even if we were advised that such loss was possible.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Services will not exceed the greater of USD 100 or the amount you paid us for the Services during the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, fraudulent misrepresentation, willful misconduct, or death or personal injury caused by negligence where the law prohibits such a limitation.
15. Governing Law and Disputes
If you have a concern, please contact us first so we can try to resolve it informally. These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles.
The courts with jurisdiction under Ukrainian law may hear disputes relating to these Terms. If you are a consumer, this choice of law and forum does not deprive you of mandatory protections or the right to bring a claim in another court available to you under the law of the country where you live.
16. Changes to These Terms
We may update these Terms to reflect changes to the Services, law, security, providers, or our business. We will post the updated Terms and change the “Last updated” date. For material changes, we will provide additional notice through the Services or by email when reasonably practicable or legally required. If the law requires your affirmative agreement, we will ask for it.
Otherwise, continuing to use the Services after updated Terms take effect means you accept them to the extent permitted by law. If you do not agree to an update, you must stop using the Services and may cancel your subscription before its next renewal.
17. General Terms
If any provision of these Terms is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or transfer of the Services, provided your mandatory rights are not reduced.
These Terms, the Privacy Policy, and any purchase terms shown at checkout are the entire agreement concerning the Services. Translations may be provided for accessibility. If translations conflict, the English version governs to the extent permitted by law, without limiting mandatory rights in your language or country.
